Can I sell it or not??????

Postby Indianbear » Mon May 21, 2007 1:05 am

Please clarify this for me.

Product information says if I puchase Flipbook Pro 6 I can sell DVD's and CD's that I produce.

If I sell those DVD's and CD's on my website do I need to purchase a SBS license?

Thanks,
Indianbear

Selling

The FlipAlbum Pro 6 license allows you to produce CD/DVD using the FlipAlbum technology. Any other license you might need is determined by your local, state, country laws.

Now what I mean.

Thanks Kenny, but I'm refering to this statement on the SBS page.

"To publish your contents in a 3D page-flipping book (FlipBook) format for online commercial distribution, you will need to buy a SBS license to use our patented Digital Flip® technology."

What constitutes "online commercial distribution?"

Is that only when people pay for and read a FlipBook directly from a web site - like paying to watch a "streaming movie"; or does it include the selling of CD's and DVD's on a website that will be delivered by mail?

I'm sure that line has been subject to interpretation by many...

To me it means that if you were going to be distributing an "online" product, which was going to be sold and viewed through the "Digital Flip®" technology, then you would be required to have their license.. If you're going to offer a CD based product from a website, it would not require the license, based on the SBS page statement.

Please remember, this is "" my interpretation ""

justs to add a word to Mike's reply -
If you put albums on your site for "advertising" purposes, they must
have the DSS - per my e-mails from support......ages ago when this topic first came up.

if you do a search on the form using DSS (Digital Signature Service) you will find a lot of discussion on this issue.

I also think that CD and DVDs are exempted from this licensing.

To add my two cents.

There is/was a method to run your flip books online, but we never did it. This is the license being spoken of. Our issue with such was that it had to be hosted on their server, or on ours with a lot of modifications to our server, and a lot of modifications to the users browsers, etc. This may no longer be the case, I do not know.

Selling 'physical' products, such as cd/dvd are exempt, as long as no internet 'handshaking' is done.

Selling 'image' of cd/dvd has been ruled, in our case, as exempt. I honestly do not know if it was the copyrights issue we brought up that caused the 'loosening up', but it could be. So be careful here. The 'image' is for and designed to be downloaded and burned to disk.

We later learned that such an image did not have to be burned, to run, merely unzip the archive and run startcd.

Hope it helped.

Sarah.
